Beyond Transparency: The Liability Void in Autonomous Agentic AI Systems
The rapid proliferation of "Agentic AI"—systems capable of autonomous goal execution and decision-making—presents a challenge that the 2024 text of the EU AI Act did not fully anticipate. As we move into the post-implementation phase of the Act in late 2026, this article explores the emerging "liability void" where autonomous agents operate outside the direct control of human operators, complicating the attribution of fault under current liability directives.
The Shift from Generative to Agentic AI
When the AI Act was drafted, the primary paradigm was Generative AI (systems that create content). By 2026, the industry has pivoted to Agentic AI (systems that execute tasks). These agents do not merely write emails; they negotiate supply chain contracts, optimize energy grids in real-time, and execute financial trades autonomously.
This shift challenges the AI Act’s "provider vs. deployer" dichotomy. If an AI agent autonomously optimizes its own parameters to maximize a vaguely defined goal (e.g., "maximize profit"), and in doing so breaches competition law or data privacy statutes, where does the liability sit?
The Human Oversight Paradox
Article 14 of the AI Act mandates "Human Oversight" for High-Risk AI Systems. However, for Agentic AI operating at millisecond speeds, effective human intervention is functionally impossible. This creates a regulatory paradox:
The Law: Requires a human to be able to "interrupt or stop" the system.
The Reality: The system operates faster than human cognition allows.

The question facing legal departments is: Is the error a product defect (Provider liability) or a misuse of parameters (Deployer liability)? Agentic AI blurs this line because the "misuse" might be an emergent property of the AI's continuous learning, which neither the provider nor the deployer explicitly programmed.
Strategic Governance for 2027 and Beyond
To mitigate these risks before the full enforcement regime settles in late 2026, we recommend three strategic pillars:
Contractual Indemnity structures: B2B contracts involving Agentic AI must explicitly define "autonomy thresholds"—the point at which an AI's decision is considered a "hallucination" versus a "feature."
Sandboxed Deployment: Agentic systems should operate in "walled gardens" with hard-coded limits on financial or data exposure until they have passed longitudinal FRIAs (Fundamental Rights Impact Assessments).
Immutable Logging: Compliance in 2026 requires more than just keeping logs; it requires immutable chains of custody for AI decision logs to prove that "reasonable care" was taken during the system's design.
